Your UK and EU Data Representative
Now that the UK has left the EU, EU-based companies that have no establishment in the UK and whose business involves UK customer or employee data are legally required to appoint a UK data representative. Likewise, UK-based companies that have no establishment in the EU and whose business involves EU customer or employee data are legally required to appoint an EU Data Representative.
This Representative must be authorised to deal on the company’s behalf with the data authorities in the UK or EU and with the company’s customers on data matters. They must be mentioned in the company’s privacy notice so the authorities and your customers know who they are and how to contact them. They must also maintain a register of the company’s data processing activities and make this available to the authorities on request.
We can assist UK brands in ensuring they remain EU-compliant and EU brands in remaining UK-compliant. We provide this service for the UK, and work with our German partner, Daschug, to coordinate this service for the EU, ensuring that we offer a fully comprehensive service.
Our aim is to provide a cost-effective service, proportionate to our clients’ needs. We charge a flat fee of GBP 1,000 per year to be your named UK data representative, to be available to the ICO and to your UK customer base, and to hold and update your register of processing activities. If we need to liaise with the ICO on your behalf, or if significant customer issues arise, we will charge this separately. This safeguards you against paying for services that you may not ever need, and we will ensure that if such services are needed we provide them to you cost-efficiently.
